American Credit Collections -- How to NOT collect a debt

Description: I got a nastygram from American Credit Collections, LLC. out of Scranton, Pennsylvania in the beginning on June, 2007. I immediately called their telephone number and received a series of harassing telephone calls. This company does not appear to be a licensed debt collector in my state, a class I felony. Additionally, their collection letter threatened post-judgment remedies, "aggressive legal action" and stated they were verifying my employment and attempting to locate assets that could satisfy the debt. Please note, this debt, if at all legitimate, is way beyond the statute of limitations. Of course, ACC has somehow managed to re-age or otherwise misrepresent the date of chargeoff. According to my records, the account was opened March 24, 1998, last payment May 10, 1999 and charged off on December 20, 1999 for $658. What follows is fantastic example of the illegal tactics that "fly by night" debt collection companies use. Be warned. Update: If you've paid these people by credit card or check, I'd love to find out the name on the account they routed the money through. Please shoot me a PM!

Oh god. These are zombie debt collectors, which are the absolute worst kind. They take debts that are way past the statute of limitations, and then pretend that they can actually collect on them. Oh, and it isn't illegal to record a phone call in any state. It is illegal only if the parties are not aware. I can tell them I am recording and if they don't hang up; well that equals consent.

yes, my daughter was called by these people today and they threatened her that sheriff will come to her house and sell everything and told her on the phone to shut up and even went thru her bank account where she only had 1 dollar and became negative. very un - professional

The horror stories I've heard over the years from hardship clients are disgusting. Feels great to KICK ASS on creditors every day. Knowledge in action is power. I work at a collection agency and it is a violation of federal for her to threaten suit, or your being served at your poe, when there is absolutely no possible way of filing suit because this is past the statute of limitations. I would like to know what happened after this, did you report them to the FTC? I would have. Let us know what happened, I'm curious.

ok this was great i my self em a bill collector and what was wrong abuot this call was this collector send she was going to have the sheriff bring pappers to his work that is wrong she vioated fdcpa a collection agency cannot threat in any way that they will be doing something to make them pay that would be up to the creditor so there for that was a really bad call from a collector they will not do that and she violated fdcpa the debtor could have sued for that. frankie j

i love it when they don't care if it's past the statute of limitations. they're basically wasting their time trying to collect, and in many states, it's illegal to try to collect a past-statute debt. i love this vid!

Being a debt collector I just want to say that 'KIM' broke the FDCPA and I just can't even understand how she still has a job. if we said half the stuff she did at my agency... we would be fired immediately!

Yes even in Nazifornia, and other Two party states that preamble is part of the recording so. Sue them Sue them if you are low income file an affidavit of inability to pay costs and you can sue them for FREE!! Go to the Justice of the Peace Courts.

After listing to the 2nd call, the person threatening to serve papers at his job violated FDCPA. I would be sueing them for that type. Also, even if they did try to sue, the suit would be dismissed due to outside of statue of limitations.

Hmmm... the recording warning means you can record them, despite any state "wiretap" laws, etc. I had a collector try to trick me into writing bad checks into the future, a felony.
